These Terms of Service (“Terms”) govern your access to and use of the SDC India website, including any quotation request, purchase, order, delivery, service request, communication, or transaction made through this website. By accessing or using this website, you agree to be bound by these Terms, together with our Return and Refund Policy, Shipping Policy, Privacy Policy, and Contact Information.
1. General
SDC India offers products and related solutions through this website, including but not limited to tiles, tile adhesives, epoxy grout, tile spacers, and other tile application materials. Certain products, quotations, deliveries, and services may also relate to project-specific requirements, labour coordination, or site-linked support where expressly agreed in writing.

We reserve the right to update, modify, suspend, or discontinue any part of the website, products, services, prices, offers, or policies at any time without prior notice, subject to applicable law.
2. Product and Service Information
We make reasonable efforts to display product descriptions, specifications, images, availability, and pricing accurately. However:
- Product images are for illustrative purposes only
- Shade, texture, tone, finish, and batch variation may occur in tiles, stones, and construction materials
- Technical suitability depends on site conditions, substrate condition, application method, intended use, and other project-specific factors
- Product recommendations, where provided, are based on the information shared by the customer and do not replace a full site inspection or technical assessment unless specifically agreed in writing
Customers are responsible for reviewing product details and confirming suitability before placing an order.

3. Quotations and Orders
All quotations, pricing, freight estimates, and product availability are subject to review and confirmation by SDC India. A quotation, estimate, or communication made through this website does not constitute a binding acceptance unless confirmed by SDC India.

SDC India reserves the right to:
- Accept or reject any enquiry, order, or request
- Correct pricing, product, freight, or availability errors
- Seek additional information before processing an order
- Revise quotations in case of stock changes, project changes, site issues, transport changes, or customer-side requirement changes
- Orders are processed only after payment confirmation, internal review, and acceptance by SDC India.

4. Pricing and Payments
All prices displayed on this website are subject to change without prior notice, subject to applicable law. Taxes, freight, handling, loading, unloading, labour, or service-related costs may be charged separately unless expressly stated otherwise.

Payment must be made using the accepted payment methods shown on the website or otherwise confirmed by SDC India. SDC India reserves the right to withhold dispatch, service scheduling, or project execution until full or agreed payment is received.
5. Shipping, Delivery, and Site Conditions
Shipping, freight, transport, loading, unloading, handling, and related logistics charges shall be borne by the customer unless otherwise expressly agreed by SDC India in writing.

Delivery timelines are indicative only and may vary based on stock availability, location, transporter schedules, weather, route conditions, labour availability, site readiness, or project requirements.
Customers are responsible for ensuring:
- Correct delivery address
- Site accessibility
- Safe delivery conditions
- Storage readiness
- Availability of labour / unloading support where required
- Site readiness for installation or project execution, where applicable 
Failure to ensure site readiness or access may result in delay, re-delivery, storage, return freight, or additional charges.

6. Inspection at Delivery
Customers must inspect materials at the time of delivery and verify quantity, visible damage, product description, packaging condition, and any relevant batch or shade details.

Any visible transit damage, shortage, wrong item, or delivery issue must be recorded and reported immediately, and in any event within 24 hours of delivery, together with supporting photographs / videos and order details.

Acceptance of delivery without timely reporting may affect eligibility for replacement, return, or related claims.

7. Returns, Refunds, and Cancellations
Returns, replacements, refunds, and cancellations are governed by our Return and Refund Policy. Customers are advised to review that policy carefully before placing an order, especially because many products sold by SDC India are technical, batch-linked, site-dependent, project-specific, or service-linked in nature.

8. Services, Labour, and Tiles Application Support
Where SDC India provides or coordinates labour, installation support, site visits, project support, or turnkey execution:
- Scope of work shall be limited to what is specifically agreed in writing
- Any excluded work, additional material, site rectification, demolition, levelling, moisture treatment, utility arrangement, access arrangement, or non-included service may be chargeable extra
- Site readiness, access, utilities, and approvals remain the customer’s responsibility unless expressly agreed otherwise

SDC India shall not be liable for delay, disruption, or additional cost arising from customer-side site conditions, access issues, third-party interference, structural problems, hidden site defects, or incomplete information.

9. Customer Responsibilities
The customer is responsible for:
- Providing accurate and complete information for quotations, orders, deliveries, and services
- Confirming product suitability, quantity, and specifications before order confirmation
- Ensuring proper storage, handling, and use of materials after delivery
- Using products only in accordance with instructions, technical guidance, and intended application
- Engaging competent labour or installers where installation is not undertaken by SDC India

SDC India shall not be responsible for issues arising from incorrect quantity estimation, wrong specification chosen by the customer, improper handling after delivery, unauthorized installation, or use contrary to product instructions or technical recommendations.

10. Limitation of Liability
To the extent permitted by applicable law, SDC India shall not be liable for any indirect, incidental, special, punitive, or consequential loss, including but not limited to business interruption, site delay, loss of profit, labour idling, rework costs, or third-party claims arising from use of this website, supply of products, logistics issues, or service coordination.

Nothing in these Terms excludes liability where such exclusion is not permitted under applicable law.
11. Indemnity
To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless SDC India, its proprietors, affiliates, employees, representatives, contractors, suppliers, and service providers from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees and expenses) arising out of or relating to:
(a) your misuse of this website;
(b) your breach of these Terms or any applicable law;
(c) any incorrect, incomplete, or misleading information provided by you in connection with a quotation request, order, delivery, site conditions, project scope, or service requirement;
(d) improper storage, handling, application, installation, use, or misuse of any product supplied by SDC India contrary to product instructions, technical guidance, industry practice, or recommended usage;
(e) any third-party claim arising from your acts, omissions, negligence, site conditions, labour engagement, or unauthorized alteration or use of products or services after delivery or handover.
Nothing in this clause shall limit any rights available to consumers under applicable law.

12. Intellectual Property
All content on this website, including text, logos, graphics, product information, images, layouts, and branding, is the property of SDC India or its licensors and may not be copied, reproduced, distributed, modified, or used without prior written permission, except as permitted by law.

13. Privacy
Your use of this website is also governed by our Privacy Policy. By using this website or submitting your information through quotation, enquiry, or contact forms, you agree that your information may be collected, used, and processed in accordance with our Privacy Policy.

We aim to acknowledge grievance communications within 3 working days and endeavour to address eligible matters within 30 days, subject to the nature of the issue, required verification, inspection, and supporting documentation.
15. Governing Law and Jurisdiction
These Terms of Service shall be governed by and construed in accordance with the laws of India. Subject to applicable law, any disputes arising out of or in connection with the use of this website, quotation requests, purchases, deliveries, returns, refunds, products, services, or any related matter shall be subject to the exclusive jurisdiction of the competent courts at New Delhi, Delhi.

16. Consumer Rights
Nothing in these Terms shall limit or exclude any rights available to consumers under applicable law.
